Contract Example

LICENCE AGREEMENT MADE
Between Newbury Properties (The Licensor)

and.......................................(the Lincensee)
It is agreed as follows:

Definitions
‘The Licence’ means the licence to occupy conferred by this agreement
‘The House’ means the Licensor’s known as
......................................................................

‘The Rooms’ means such room or rooms in the house as are from time to time allotted by the Licensor to the Licensee.
‘The contents’ means the furniture and furnishings used by the Licensee from time to time as provided for by the Licensor.

Declaration
This agreement is not intended to confer exclusive possession upon the Licensee, nor create the relationship of landlord and tenant between the parties. The licensee shall not be entitled to an assured tenancy or a statutory periodic tenancy or to any other statutory security of tenure now or upon the termination of the Licence.

Sharing Agreement
The Licensor permits the Licensee to share the occupation of the rooms with such a person or persons as the Licensor may nominate, occupation being by the Licensee personally and such person or persons only and to use the Licensor’s furniture and furnishings in the rooms until termination of the licence.

Consideration
The Licensee shall pay to the Licensor in respect of the occupation of the rooms. The licensee will be entitled to occupy the rooms for 44 weeks from 9th September 2011 to 13th July 2011 (inclusive dates) subject to having paid the above consideration. The licensor shall provide hot water and electricity together with heating to the rooms. The Licensee acknowledges that no illegal substances may be brought into the house.

Keys
The licensor shall issue to the licensee only one set of keys to the rooms and to the house. A deposit of £5.00 will be required and this will be refunded on surrender of the keys at the end of the agreement. If the Licensee loses a key, the Licensor will replace it upon the Licensee paying the cost of having a replacement cut. The licensor shall retain his own set of keys and he and any persons authorised by him may exorcise the right to use these keys and obtain free entry to the rooms at any time.

The Licensee agrees to abide by any management rules which the Licensor may make in respect of the house and the occupation by the licensee.

The Licensee shall use his best endeavours to share the use of the house amicably and peaceably with the Licensor and with such other Licensees as the Licensor shall from time to time permit to use the house and shall not interfere with or otherwise obstruct such shared occupation in any way whatsoever.

The Licensee shall keep the rooms and the contents in good condition and shall not remove any contents from the rooms and shall make good all damage to the contents and replace with articles of a similar kind and value any broken or damaged by the licensee as reasonably requested by the Licensor.

The Licence may be determined by the Licensor for a period of 44 weeks certain and will only be able to determine this agreement before the expiry of the 44 weeks under the following circumstances:

In the event of the Licensee having illegal substances in the house, or committing any other serious breach either of this agreement or of the house rules, the Licensee will be required to leave the house immediately and this licence will be terminated forthwith. Any refund of rent in advance paid under this clause will be at the discretion of the Licensor.

Subject to any further rules which may be made by the Licensor, this agreement embodies the entire understanding of the parties relating to the rooms and the house and to all the matters dealt with by any of the provisions of this agreement. The Licensee acknowledges that he has received a copy of this agreement and has read and understood it and having inspected the rooms and contents declares that he finds them in good condition.
